1. Acknowledgement of Understanding
The policies described herein represent the Terms of Use of CUBANA TABACO’s website, e-commerce site and on-line store, and constitute a legal agreement between you—the supplier, partner, or customer—and CUBANA TABACO Tobacco. By accessing our website(s) or web pages, you acknowledge that you have read, understand, and agree to comply with these policies, as well as all applicable state, federal or other laws and regulations, including the sale and/or purchase of products or services made available by CUBANA TABACO Tobacco. If you do not agree with or do not wish to comply with the policies contained herein, please do not use this website.

CUBANA TABACO reserves the right to at any time and without notice update, append, or rescind in whole or part its Terms of Use or other policies, as appropriate to comply with state, federal or internal laws, regulations, or policies. Furthermore, we may at any time and without notice update, append, or rescind in whole or part any information contained on our website(s) or on our web pages, including that related to our products, services, prices or related policies, processes, procedures, or instructions.
3. Ordering
Customers shall inspect Sales Orders, Invoices, Order Confirmations, Transaction Receipts, and other communications related to orders immediately upon receipt for accuracy and completeness, including but not limited to billing and shipping addresses, items ordered, quantities, pricing, and shipping costs. These documents are system-generated and are transmitted securely, instantly, and automatically to customers upon placement of orders. If these documents are missing or not received following order submission, and after checking junk mail and spam folders, customers should contact CUBANA TABACO Support via our website contact form immediately for replacement or retransmission. Upon thorough inspection of these documents, customers shall report any order discrepancies to CUBANA TABACO Support via email immediately upon discovery and not later than 24 hours following receipt of these communications. Orders cannot be returned, cancelled, refunded, or replaced based on address, product, pricing, shipping cost, or other errors or omissions as submitted by the customer or received electronically by CUBANA TABACO, or reports of such errors or omissions submitted more than 24 hours after the order is received by CUBANA TABACO.
4. Shipping
We maintain contracts with multiple freight and ground carriers to deliver the appropriate service levels, based on destination, transit times, order sizes, fuel costs, and other variables, and carriers are chosen at our sole discretion. Although never guaranteed, we may offer free, discounted, or flat-rate shipping on qualifying orders based on criteria determined at our sole discretion, and we may cancel or suspend this service at any time without notice at our sole discretion.
5. Damages
Although unlikely to occur, we are not liable for loss or damage of or to merchandise not in our possession or under our control, such as during transit, delivery, or at the customer’s location. We are happy to assist our customers and partners with claims for orders received damaged by carriers.
6. Cancellations
CUBANA TABACO happily accepts order cancellation requests without penalty if submitted before the order has shipped. Cancellation requests received after the order has shipped cannot be accepted.
7. Lost or Stolen Packages
We cannot be held responsible for lost or stolen packages after delivery as reported by the carrier.
8. Returns
Only merchandise shipped by CUBANA TABACO in error will be considered for return through the Return Merchandise Authorization (RMA) process. RMA claims must be reported via our customer contact form process no later than the next business day following receipt. Claims must include a written description of the issue. CUBANA TABACO will request photographic evidence attached in JPEG or PNG file format. Customers must not return merchandise until we have granted approval through the RMA process and authorization to ship has been received by the customer. Merchandise returned before or without RMA approval from CUBANA TABACO will not be considered for credit or replacement, and all related shipping charges will be borne by the customer. Authorized returns must be received by CUBANA TABACO unopened, unaltered, and without damage. Merchandise received that has been altered in presentation, appearance, or quality, including but not limited to branding, pricing, or other marking or labeling will not be considered for credit or replacement, and all related shipping charges will be borne by the customer.
9. Age Verification
Access to and use of CUBANA TABACO’s website, including its web pages, content, products, services, advertisements, and cross-links, is intended for use by adults of legal age to purchase tobacco products only. We do not believe that young people should smoke or use tobacco products, and we do not promote, support, or otherwise encourage it. We do not advertise or market our manufacturers' products or services to persons not of legal age, and we support programs designed to eliminate, reduce, or discourage smoking and the use of tobacco products among youth. We take this policy seriously and go to great lengths to restrict access to our manufacturers' products and services to adults of legal age, including age verification and attestation to the reading and understanding of these terms and conditions. PERSONS NOT OF LEGAL AGE TO PURCHASE AND USE TOBACCO PRODUCTS, OR PERSONS OTHERWISE BANNED OR PROHIBITED BY LAW OR CUBANA TABACO POLICY OR DECLARATION FROM ACCESSING THIS SITE, PURCHASING, OR USING TOBACCO PRODUCTS SHOULD LEAVE IMMEDIATELY. DELIBERATE VIOLATION OR DISREGARD FOR THESE TERMS MAY BE DEEMED ILLEGAL AND WILL RESULT IN IMMEDIATE TERMINATION OF SERVICES WITHOUT NOTICE, AND/OR PROSECUTION IN ACCORDANCE WITH APPLICABLE LAWS.
10. Use of Copyrighted of Trademark Material
CUBANA TABACO’s website and/or web pages contain proprietary information, including copyrighted or trademark material. Our website, web pages, or content developed or contained therein may not be copied, reproduced, or distributed without our expressed written permission. Furthermore, actions or attempts to deliberately misrepresent your relationship with CUBANA TABACO, including statements or implications that CUBANA TABACO approves or endorses you, your company, your website, your product(s), or service(s) are similarly prohibited. We assume no responsibility for screening our third-party advertisers or their content or testing the security of their websites. Accordingly, we hereby disclaim all responsibility for actions or events occurring because of you visiting third-party websites, even by means of references or links from our own website or web pages and including those actions or events resulting in potential business interruption, loss of profits or revenue, assets, time, or other resources.
